Sale, Returns and Refunds

Making a purchase

To place an order browse our products and click on any items that you wish to buy and put them into your ‘Shopping Cart’. After you have finished your selection, click on ‘Shopping Cart & Proceed to Checkout’, you can do so via logging on to your account or via our guest checkout where you will need to provide us with certain compulsory personal information in order for us to process your order. We will not store the details that you provide via guest checkout (save for processing your order, or if you have opted in to receive marketing from us).

When you create an account we may provide you with and/or ask you to use passwords or other means to allow you to access certain areas of the Website and/or to maintain your account security. It is your responsibility to maintain the confidentiality of your password and account information. Harris-Williams shall not be liable to any person for any loss or damage which may arise as a result of any failure by you to protect your password or account. Acceptance of your order

Please note that completion of the online checkout process does not constitute our acceptance of your offer to purchase products or services from us. We will notify you by email as soon as possible to acknowledge that we have received and are processing your order. Our acceptance of your order will take place only when we take payment from you and despatch the product(s) or on commencement of the services that you ordered from us. Prior to despatch of the product(s), Harris-Williams has the right to decline an order for any reason, including legal and regulatory reasons.

Changes to your order

Any changes to your order must be notified to us in writing via email [email protected] and within a reasonable time. If you amend or change your order you may find there are changes to your delivery timetable and / or the price you pay for the item (you will be charged the current selling price on the day you amend your order).

Credit cards and security

Harris-Williams accept major credit and debit cards including Visa, Mastercard, Switch and Delta through our payment service provider Stripe (http://stripe.com). All orders are ‘encrypted’ to ensure safe transmission to us. We utilise secure server software (SSL) to ensure your information cannot be read as it travels over the Internet.

If the issuer of your card refuses to authorise payment to us, we will not be liable for any delay and / or non-delivery of your order. No orders will be accepted or processed without a valid card payment in the name of the registered cardholder.

Ownership of goods

All items supplied to the customer remain the property of Harris-Williams until final payment of all sums owing in respect of those goods has been received in full by us.

Products, prices and content

Whilst every effort is made to ensure the pictures and colours depicted on the site match as closely as possible those of the product, due to technical limitations, some colours may vary.

All prices are shown in pound sterling (£). Prices, product descriptions and specifications are checked and whilst every effort has been made to make them accurate, no responsibility will be accepted for errors and omissions.

Any information displayed on our web site or other printed matter by us is not regarded to be authoritative or certified as the best practice and is only considered to be useful supplementary advice to other certified codes of practice. All information on our Website is updated regularly.

We reserve the right to alter our prices and specifications without notice.

We reserve the right to make minor changes to the products. We may change the product(s) to reflect changes in relevant laws and regulatory requirements; and to implement minor technical adjustments and improvements. These changes will not affect your use of the product.

Right to cancel

You have the right to cancel this contract within 14 days from the day after the goods have been received without giving any reason. The cancellation period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods or, in the case of multiple goods under one order, when the last of the goods is similarly acquired. To exercise the right to cancel, you must inform us via email: [email protected] of your decision to cancel this contract by a clear statement. We will then communicate to you an acknowledgement of receipt of such a cancellation on a durable medium (e.g. by email) without delay. To meet the cancellation deadline, it is sufficient for you to send your communication concerning your exercise of the right to cancel before the cancellation period has expired.

Effects of cancellation

If you cancel this contract, we will reimburse to you all payments received from you, including the costs of delivery. We may make a deduction from the reimbursement for loss in value of any goods supplied, if the loss is the result of unnecessary handling by you. We will make the reimbursement without undue delay, and not later than – (a) 14 days from the day you return any goods supplied, or provide evidence that you have returned them, or (b) if there were no goods supplied,14 days from the day on which we are informed about your decision to cancel this contract. We will make the reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of the reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest. The deadline is met if you send back the goods before the period of 14 days has expired. You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

Return Costs

We will pay the costs of a return if the products are faulty or not what you ordered. If you are ending the contract because we have told you of an upcoming change to the product or these terms, an error in pricing or description, a delay in delivery due to events outside our control or because you have a legal right to do so as a result of something we have done wrong. In all other circumstances (including where you are exercising your right to change your mind) you must pay the costs of return.

Damaged or incorrectly supplied products

Please check all ordered products. If the products you receive are damaged or incorrectly supplied on delivery then you must note the details of any damage or error in supply on the delivery documentation. You must return the products to us as soon as possible after informing us that the products are damaged or have been incorrectly supplied.

Damage during the course of returning products: If you choose to return any products to us, we will not be responsible for any loss or damage to them in transit and, for this reason, we recommend that you use a recorded delivery service. If returned products are lost or damaged in transit, we reserve the right to charge you (or not to refund any amounts attributable to) such loss or damage. In the case of damaged or incorrectly supplied goods, we may offer you a replacement product.

Other cancelled products

If you want to cancel products that are not damaged or incorrectly supplied, then you must inform us of this within 14 calendar days after the day on which you received the goods or services in accordance with the Regulations or otherwise as soon as possible. You must take good care of the products that you wish to cancel. Products should be returned in or with their original packaging, collection arrangements made, promptly at your cost which will be notified to you at the time of cancellation.

This is not intended to be a full statement of all your rights under the Regulations. Full details of your rights under the Regulations are available in the UK from your local Citizens’ Advice Bureau or your Local Authority’s Trading Standards Office.
Any refunds given by us will be made to the debit/credit card account or by cheque (as applicable)  provided when you placed your order and will be subject to our right to withhold amounts for products which are damaged on return or for which we arrange collection, as outlined above.
Where we deliver products to a third party in accordance with your order, you will only be able to exercise this cancellation right if you can return the goods to us.

Delivery

It is our aim to deliver to you within 5-7 working days of the receipt of your order. Please note, we cannot be held responsible for any third-party involvement where delays occur to deliveries. We deliver to most postal areas in mainland UK. We are not responsible for delays outside our control. If our supply of the products is delayed by an event outside our control then we will contact you as soon as possible to let you know and we’ll take steps to minimise the effect of the delay. Provided we do this we will not be liable for delays caused by the event, but if there is a risk of substantial delay you may contact us to end the contract and receive a refund for any products you have paid for but not received.

All risk in the products you order (including risk of loss and/or damage to the products) shall pass to you when they are delivered to the delivery address specified in your order.

We shall be under no liability for any delay or failure to deliver products if the delay or failure is wholly or partly caused by circumstances beyond our control.

Where the supply of your product(s) is delayed or prevented for reasons beyond our control (for example, material shortages, import delays or higher than anticipated demand) we will make every effort to keep you informed but shall be under no liability to you for such delay or failure.

Returns and exchanges

We want you to be delighted with your purchase but if you are not you can return any item within 30 days of receipt as long as it is returned unused and in its original packaging with a valid invoice/reciept in a re-saleable condition.

We will be happy to exchange the item for a replacement or to make a refund which will go onto the card which was used when you made your purchase. We are not able to refund any postage charges. Postage will be charged for sending any exchange items by post.

You have a right to cancel your order within seven working days of receiving your purchase. This seven day period begins the day after you receive the items from us. Please notify us in writing within seven working days that you wish to cancel your order and that you intend to return the item(s) and we will be happy to offer you a full refund including your original delivery charge.

How to return something

Please contact us for returns information by email: [email protected] You can return an item as long as you have your invoice, receipt or delivery note. Please send your return by post.  Please let us know whether you require an exchange or a refund and always include a daytime telephone number and your email address. If you no longer have your delivery note, please include a letter giving your name, address, email address and daytime telephone number plus a note of what you are returning and why and whether you want a refund or exchange for another product. Make sure your items are securely wrapped. 

Parcels are returned at your own cost, and we strongly recommend you obtain a free certificate of postage from the Post Office as we are responsible for your parcel only once it has been received into our warehouse. Items lost in transit will not be treated as returned.

If you choose to return any products to us, we will not be responsible for any loss or damage to them in transit and, for this reason, we recommend that you use a recorded delivery service. If returned products are lost or damaged in transit, we reserve the right to charge you (or not to refund any amounts attributable to) such loss or damage.

Faulty items

We are always disappointed if our customers receive a faulty item. If you have identified the fault within 30 days of purchase, please contact us and let us know the details of the fault. We can then let you know whether to return it or not and make sure other items are not affected. We may ask you to email us a photograph of the fault as it’s easier for you than posting it back to us. Should you need to return the item we will refund any standard second class postage on a faulty item. We strongly recommend you obtain a free certificate of postage from the Post Office as we are responsible for your parcel only once it has been received into our warehouse. Items lost in transit will not be treated as returned.

If a fault develops outside of the 30 day return period, contact us on 07447 392978 (Monday – Friday 9am to 5pm) or by email [email protected] before you return the item so we can discuss the fault with you and agree the next steps. Read any specific care instructions provided with your purchase. We cannot accept an item returned as faulty if the appropriate product care instructions have not been followed and the damage caused to the product is clearly due to wear and tear or misuse.

How to arrange for an exchange

If the product you require is still available we will be happy to exchange it for you. If the new item you require costs less than the one you have returned we will refund you the difference. If it costs less than the one you have returned we will need to take an additional payment from you before we can send you the item. We will charge you standard postage and packaging. Please make sure you give us a daytime telephone number or your email address so we can contact you. Email us at [email protected]

Returns purchased from a show

If you have bought a product(s) from Harris-Williams at a show or fair, you can return your item(s) as long as you have your receipt. Follow the same instructions as ‘How to return items’ section above.

Gift returns

An item that was received as a gift can be returned for an exchange. An email will be sent to the person who made the original purchase when the exchange is completed. Refunds can only be made to the original credit or debit card on which the gift was purchased.

Returns timing

Once your parcel has been received by us it can take up to 10 working days to fulfil your request. When we have dealt with your parcel we will confirm this to you by email, assuming you have given us your email address. Please remember that it can take three to four days after we have processed a refund payment for it to appear on your credit card statement.

If, after sending your return to us, you have not received our email confirmation within 10 working days, please contact us on 07447 392978 (Monday – Friday 9am to 5pm) so we can investigate.

Assignment, waiver and third party rights

We may update or amend these General Terms and Conditions of Sale from time to time to comply with law or to meet our changing business requirements without notice to you. Any updates or amendments will be posted on the Website.

You may not assign or sub-contract any of your rights or obligations under these General Terms and Conditions of Sale to any third party unless we agree in writing. We may assign, transfer or sub-contract any of our rights or obligations under these General Terms and Conditions of Sale to any third party at our discretion. No relaxation or delay by us in exercising any right or remedy under these General Terms and Conditions of Sale shall operate as waiver of that right or remedy or shall affect our ability to subsequently exercise that right or remedy. Any waiver must be agreed by us in writing.

If any of these General Terms and Conditions of Sale are found to be illegal, invalid or unenforceable by any court of competent jurisdiction, the rest of these General Terms and Conditions of Sale shall remain in full force and effect.

Only you and we shall be entitled to enforce these Terms of Sale. No third party shall be entitled to enforce any of these Terms of Sale, whether by virtue of the Contracts (Rights of Third Parties) Act 1999 or otherwise.

These General Terms and Conditions of Sale are governed by the laws of England and Wales and any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

We may delete any user account at our sole discretion.
